Legal Basis for Participation in the Promotion

“Valentine’s Day Giveaway”

Promotion Organizer:

The company Finca Valonga, with registered address at Monte Valonga s/n 22533, Belver de Cinca Huesca, and tax identification number A08893679, organizes, for promotional purposes, the giveaway (hereinafter referred to as “the Promotion”) to be carried out via the Internet, exclusively for users residing in the Spanish peninsula and who are of legal age, as stated in the participation conditions.

Start Date and End Date

The Promotion will start on February 7, 2024, and will end on February 14, 2024.

Participation Requirements and Promotion Mechanic

It is important to emphasize that participation in the Contest implies unconditional acceptance and compliance with the provisions set forth in these Legal Terms.
The participation requirements are as follows:

• Individuals residing in the Spanish peninsula and who are at least 18 years old are eligible to participate.
• The personal information provided by participants must be accurate.
• The mechanics of the Promotion involve liking the post, following the official Instagram account of Finca Valonga: @finca_valonga, and tagging at least one person in the comments.

Promotion Conditions and Prizes

One (1) winner and three (3) alternates will be selected through a random draw on February 15, 2024.
The winners and alternates will be selected randomly using the AppSorteos platform. This platform ensures the transparency of the draw result and issues a validity certificate for each of its draws.
The winner will receive a prize consisting of a bottle of Teresa Brut sparkling wine and a 1/2-pound package of shelled Valonga walnuts. The winner may contact the Company within a 1-day period starting from the date of the announcement on the brand’s social profile. If no contact is made within the specified timeframe, another winner will be selected from the alternates, or the giveaway will be declared void.
The conduct of the draw and the awarding of the prize are subject to current tax regulations.

Limitations

If it becomes evident that any of the participants do not meet the requirements set forth in these Terms, or if the data provided for participation is not valid, their participation will be considered void, and they will be automatically disqualified from the Promotion, forfeiting all rights to the prizes awarded under this Promotion.
The following individuals are not eligible to participate in the Promotion: (i) employees of the companies and other legal entities linked to Finca Valonga, (ii) Any other individual who has directly or indirectly participated in the organization of this contest or has been directly or indirectly involved in its preparation or development (agency, suppliers, etc.).
The prize awarded is not transferable, nor is it subject to changes, alterations, or compensation at the request of the participants, and it cannot be exchanged for any other product or cash.
Finca Valonga reserves the right, with prior legal notice, to make any changes, suspend, or extend this Promotion.
The winner is responsible for any tax or fiscal charges that accepting the prize may incur, as well as any other expenses related to the promotion that are not expressly covered by Finca Valonga in these Legal Terms.
A period of FIFTEEN (15) natural days from the date of prize allocation is established for making any justified claims. Finca Valonga reserves the right, if necessary, to substitute the prize with others of similar characteristics.

Publication of Comments or Opinions

Comments or opinions deemed inappropriate, offensive, discriminatory, or potentially infringing on the rights of third parties will not be allowed. Comments that target individuals in a way that violates the principles of the right to honor, personal and family privacy, and one’s own image will not be allowed either. We are not responsible for any damages caused by comments made by participants in the Promotion that may offend the sensibilities of other participants.
Any attempt to disrupt the proper conduct of the Contest, whether through human intervention or automated means, will result in the immediate disqualification of the participant, and their candidacy will be invalidated.

Facebook / Instagram

The promotion is not sponsored, endorsed, administered, or associated with Facebook/Instagram in any way. Therefore, Participants release Facebook from all liability for any potential damages arising from it.

Changes

We reserve the right to modify or expand these promotional terms, as long as it does not harm the rights of the participants in the Promotion.

Applicable Law and Jurisdiction

These legal terms will be governed in accordance with Spanish law. The competent authority to resolve any claims or disputes that may arise regarding the validity, interpretation, or compliance with these terms shall be the courts.
